In an important case highlighting the consequences of misrepresenting facts to U.S. immigration authorities, a United Kingdom national was sentenced in federal court following a conviction for providing false information on an immigration application. As reported by Law Office of Ben Ezra Eran, this case underscores the seriousness of immigration benefit fraud and the legal repercussions for those attempting to conceal criminal histories or prior identities.
On April 18, 2025, the U.S. Attorney’s Office in Boston announced that Duncan Hollands, also known as Duncan Herd, was sentenced to time served (one day in custody) and placed on two years of supervised release. As a result of his conviction, Hollands now faces removal proceedings.
According to court documents, Hollands falsely claimed on his U.S. lawful permanent resident application and during his interview that he had never used another name and had no criminal background. In reality, under the name Duncan Herd, he had been convicted and imprisoned for more than three years in the United Kingdom for crimes including obtaining property by deception. He had also had other legal issues in both the U.K. and France.
For our clients, this case serves as a critical reminder of the importance of truthfulness and full disclosure in all immigration filings. Misstatements — even those that seem minor or that occurred years earlier — can have serious, life-altering consequences, including criminal charges, removal, and permanent ineligibility for future immigration benefits.
